PinkFlag Terms of Service

Welcome to PinkFlag. By accessing or using our app, you agree to be bound by these Terms of Service.

1. ACCEPTANCE OF TERMS

By creating an account or using PinkFlag, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

2. SERVICE DESCRIPTION

PinkFlag provides access to public sex offender registry information aggregated from publicly available sources. The service allows users to search for individuals in these public registries.

3. ELIGIBILITY

You must be at least 17 years old to use PinkFlag. By using the app, you represent that you meet this age requirement.

4. USER ACCOUNTS

4.1. Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You agree to notify us immediately of any unauthorized access

4.2. Account Termination

• You may delete your account at any time through the Settings screen
• We reserve the right to suspend or terminate accounts that violate these terms
• Upon termination, all your data will be permanently deleted

5. CREDITS AND PURCHASES

5.1. Search Credits

• Searches require credits, which can be purchased through the app
• Credits are non-refundable except as required by law
• Credits do not expire
• Credits have no cash value

5.2. Pricing

• All prices are in USD and subject to change
• Apple's 30% commission applies to all purchases
• Taxes may apply based on your location

5.3. Refunds

• Refund requests are handled according to Apple's App Store policies

6. ACCEPTABLE USE

You agree NOT to use PinkFlag for:

6.1. Prohibited Activities

• Harassment, stalking, or threatening others
• Discrimination or hate crimes
• Employment, credit, or housing decisions (FCRA violations)
• Any illegal activity
• Circumventing credit system or attempting fraud
• Automated scraping or data harvesting
• Creating false or misleading reports

6.2. Legal Compliance

• You must comply with all local, state, and federal laws
• You are responsible for how you use information obtained from PinkFlag

7. DATA AND PRIVACY

7.1. Data Collection

• We collect email, search history, and purchase data
• See our Privacy Policy for complete details
• We do not sell your personal information

7.2. Search History

• Your searches are stored in your account
• You can delete individual searches or clear all history
• Deleted data cannot be recovered

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• PinkFlag is not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the service in the past 12 months
• We are not responsible for actions taken based on app data
• We are not liable for third-party data inaccuracies

10. INDEMNIFICATION

You agree to indemnify and hold PinkFlag harmless from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these terms
• Your violation of any laws or third-party rights
• Misuse of information obtained through the app

11. THIRD-PARTY SERVICES

PinkFlag integrates with:

• Apple App Store (payments)
• Supabase (database, authentication)
• RevenueCat (subscription management)
• Offenders.io (registry data)

Each service has its own terms of service governing their use.

12. INTELLECTUAL PROPERTY

12.1. PinkFlag Content

• The PinkFlag app, logo, and design are owned by PinkFlag
• You may not copy, modify, or distribute our intellectual property
• User-generated content remains yours

12.2. Registry Data

• Public registry data is owned by respective government agencies
• PinkFlag has no ownership over public record information

13. MODIFICATIONS TO TERMS

We may update these Terms of Service at any time. Changes will be effective when posted with an updated "Last Updated" date. Continued use of PinkFlag after changes constitutes acceptance.

14. GOVERNING LAW

These terms are governed by the laws of the United States and the State of California, without regard to conflict of law provisions.

15. DISPUTE RESOLUTION

15.1. Informal Resolution

• We will attempt to resolve issues informally first

15.2. Arbitration

• Disputes not resolved informally shall be settled by binding arbitration
• Arbitration will be conducted in accordance with AAA rules
• You waive the right to participate in class action lawsuits

16. CHILDREN'S USE

PinkFlag is not intended for users under 17 years of age. We do not knowingly collect information from children under 17.

17. ACCESSIBILITY

We strive to make PinkFlag accessible to all users. Contact us if you encounter accessibility issues.

18. EXPORT CONTROLS

You agree to comply with all applicable export laws and restrictions.

19. SEVERABILITY

If any provision of these terms is found unenforceable, the remaining provisions will remain in full effect.

20. ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and PinkFlag.

25. APP STORE TERMS

Your use of PinkFlag is also subject to Apple's App Store Terms of Service. In case of conflict, Apple's terms take precedence for App Store-related matters.
