CustomCrypto Terms and Conditions

1. ACCEPTANCE OF TERMS

Welcome to CustomCrypto! These Terms and Conditions ("Terms") govern your access to and use of the CustomCrypto mobile application (the "App"). By creating an account or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

2. DESCRIPTION OF SERVICE

CustomCrypto is a cryptocurrency paper trading simulator and educational platform. The App allows you to:

• Practice cryptocurrency trading with virtual money ($10,000 starting balance)
• Track a simulated portfolio with real-time market prices
• Set price alerts for cryptocurrencies
• Access educational content about cryptocurrency and trading
• View portfolio analytics and performance charts

3. ELIGIBILITY

You must be at least 13 years old (or 16 in the EEA) to use the App. By using the App, you represent and warrant that:

• You are at least 13 years old (or 16 in the EEA)
• You have the legal capacity to enter into these Terms
• You will not use the App for any illegal purpose
• All information you provide is accurate and truthful

4. ACCOUNT REGISTRATION

4.1 Account Creation

To use the App, you must create an account by providing:

• A valid email address
• A secure password
• Optional display name

Alternatively, you may sign in using Apple Sign-In (iOS only).

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We are not liable for any loss or damage from your failure to protect your account credentials.

4.3 One Account Per User

You may only create one account. Creating multiple accounts to manipulate achievements, leaderboards, or other features is prohibited.

6. MARKET DATA & PRICING

6.1 Third-Party Data

Cryptocurrency prices are sourced from CoinGecko API, a third-party service. We do not guarantee:

• Accuracy of price data
• Real-time updates (prices may have delays)
• Availability of data at all times

6.2 Not Financial Advice

Price information, charts, and analytics are provided "as-is" for educational purposes only. CustomCrypto does NOT provide financial, investment, or trading advice.

6.3 Price Alerts

Price alerts are provided on a best-effort basis. We do not guarantee:

• Delivery of all alert notifications
• Accuracy of alert triggers
• Timeliness of notifications

7. USER CONDUCT

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to hack, reverse engineer, or compromise the App's security
• Create multiple accounts or use automated tools (bots)
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Impersonate others or provide false information
• Scrape or collect data from the App without permission
• Use the App to spam or send unsolicited messages

Violation of these rules may result in account suspension or termination.

8. INTELLECTUAL PROPERTY

8.1 Our Rights

All content, features, and functionality of the App are owned by CustomCrypto and are protected by copyright, trademark, and other intellectual property laws. This includes:

• App design, code, and software
• Logos, graphics, and user interface
• Educational content and articles
• Database structure and organization

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8.3 Prohibited Uses

You may NOT:

• Copy, modify, or distribute the App
• Create derivative works based on the App
• Sell, rent, lease, or sublicense the App
• Remove copyright or proprietary notices
• Use the App's content for commercial purposes

9. EDUCATIONAL CONTENT

9.1 Accuracy

We strive to provide accurate educational content, but we do not guarantee:

• Completeness or accuracy of all information
• That content is up-to-date at all times
• That content is suitable for your specific situation

9.2 Not Professional Advice

Educational content is for informational purposes only and does NOT constitute:

• Financial advice

• Tax or legal advice

Educational articles may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of external sites.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11.1 No Damages

CUSTOMCRYPTO, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of business opportunities
• Emotional distress or personal injury

11.2 Maximum Liability

Our total liability for any claim related to the App shall not exceed $100 USD or the amount you paid us in the last 12 months (whichever is greater). Since the App is free, this means our maximum liability is $100 USD.

11.3 Exclusions

Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless CustomCrypto and its affiliates, officers, employees, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of applicable laws or regulations

13. TERMINATION

13.1 By You

You may terminate your account at any time by:

• Contacting our support team at bobby@customapps.us
• Following in-app account deletion instructions

13.2 By Us

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account is inactive for an extended period
• We discontinue the App
• Required by law

13.3 Effect of Termination

Upon termination:

• Your access to the App will be revoked
• Your account data may be deleted (subject to legal retention requirements)
• Virtual portfolio and balances will be permanently lost
• These Terms will continue to apply to past use of the App

14. MODIFICATIONS TO THE APP

We reserve the right to:

• Modify, suspend, or discontinue the App (or any features) at any time
• Change these Terms at any time
• Update pricing (if we introduce paid features in the future)

14.1 Notice of Changes

For material changes, we will:

• Update the "Last Updated" date
• Provide in-app notifications
• Send email notifications (for significant changes)

14.2 Acceptance of Changes

Your continued use of the App after changes constitutes acceptance. If you do not agree to changes, you must stop using the App and delete your account.

15. PRIVACY

Your privacy is important to us. Please review our Privacy Policy (incorporated by reference into these Terms) to understand how we collect, use, and protect your information.

16. DISPUTE RESOLUTION

16.1 Informal Resolution

Before filing any legal claim, you agree to contact us first to attempt informal resolution. Email us at bobby@customapps.us with a description of the dispute.

16.2 Arbitration Agreement

If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except:

• Small claims court disputes (under $10,000)
• Intellectual property disputes
• Disputes where arbitration is prohibited by law

16.3 Arbitration Process

• Arbitration will be conducted by the American Arbitration Association (AAA)
• Rules: AAA Consumer Arbitration Rules
• Location: Massachusetts
• Costs: We will pay arbitration fees for claims under $10,000

16.4 Class Action Waiver

You agree to bring disputes in an individual capacity only, not as part of any class, consolidated, or representative action. There will be no right or authority for any dispute to be brought as a class action.

17. GOVERNING LAW

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be brought in the courts located in Massachusetts.

18. MISCELLANEOUS

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CustomCrypto.

18.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full effect.

18.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

18.4 Assignment

You may not assign or transfer these Terms. We may assign these Terms to any affiliate or successor without restriction.

18.5 Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control (e.g., natural disasters, wars, pandemics, internet outages, third-party service failures).

18.6 Export Compliance

You agree to comply with all export and import laws and regulations applicable to the App.

19. APPLE APP STORE (iOS)

If you downloaded the App from the Apple App Store, you acknowledge:

• These Terms are between you and CustomCrypto, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for the App or its content
• Apple is a third-party beneficiary of these Terms and may enforce them
